Terms of Service
These terms govern your use of DivePrep, an operations tool for dive centers. Please read them — they explain what DivePrep does, what you pay for, and, importantly, where our responsibility ends and yours as a dive center begins.
1. Who we are & accepting these terms
DivePrep (“DivePrep”, “we”, “us”) is operated by DivePrep, Switzerland. You can reach us any time at support@diveprep.app.
By creating an account, or by using DivePrep on behalf of a dive center, you agree to these terms. If you are accepting on behalf of a business, you confirm you are authorized to bind that business.
2. What DivePrep is
DivePrep is a planning and operations tool for dive centers. It helps you schedule trips, manage divers and their gear preferences, generate gear-prep checklists, take public booking requests, and collect booking payments through your dive center’s own payment account. It is administrative software — a way to organize your operation.
Booking payments your divers make through DivePrep are processed on your dive center’s own Stripe (or Wise / custom) account. DivePrep never holds those funds and takes no commission on them.
3. Accounts & organizations
You sign in with an individual account and operate one or more dive-center organizations. You are responsible for keeping your credentials secure and for the activity of the members you invite. Members hold roles (admin, staff, viewer) that determine what they can do; org admins manage their own team.
You must give accurate information, be old enough to run a business in your jurisdiction, and use DivePrep lawfully.
4. Plans, limits & billing
DivePrep offers three plans. Every feature is available on every plan — plans differ only by usage limits:
- Free — €0, up to 10 trips per month, 1 dive center. Free forever for small shops.
- Club — €19 per month, up to 30 trips per month, 1 dive center.
- Pro — €49 per month, up to 9,999 trips per month, up to 5 dive centers on one subscription.
Prices are in euros (EUR) and exclude VAT where applicable. Paid plans are billed monthly in advance through Stripe. A month’s usage is counted by trip date, in your dive center’s time zone, and resets at the start of each calendar month.
- Cancel anytime. Cancellation takes effect at the end of the current billing period; you keep your paid plan until then, and there are no partial-month refunds for the remainder of the period.
- Plan changes are immediate and prorated. Upgrades and downgrades take effect right away, with Stripe prorating the difference on your next invoice.
- Free-tier data retention. If you move to a lower plan (or a payment fails and your account returns to Free), your historical trips, divers, and records are guaranteed to be kept for a minimum duration of 12 months on the Free tier. Being over a limit only blocks creating new trips for the rest of that month.
- 12-month price lock. The price you subscribe at is locked for 12 months from signup. If we change our prices, your rate stays the same until that period lapses.
If a payment fails, Stripe retries it and we keep your plan active during a short grace period. If it ultimately cannot be collected, your account returns to the Free plan under the Free-tier data retention terms above.
5. Acceptable use
You agree not to:
- use DivePrep to break the law or infringe anyone’s rights;
- upload malware, attempt to breach or overload the service, or probe it without authorization;
- reverse-engineer, resell, or misrepresent the service; or
- enter personal data about your divers that you have no lawful basis to process.
We may suspend accounts that put the service or other customers at risk.
6. Your data & export
The operational data you enter about your dive center and its divers is yours. We process it to provide the service (see our Privacy Policy). You can export your organization’s data from within the product at any time, on every plan, and you can delete your account from your settings.
7. Your responsibility for diving operations
DivePrep is a planning and administrative aid. It does not replace your professional judgment, your safety standards, or your legal and regulatory obligations as a dive center.
Checklists, gear summaries, form-status flags, and reminders in DivePrep are conveniences to help you organize — they are not certifications, safety approvals, or clearances. You remain solely responsible for:
- waivers, liability releases, and consent;
- medical clearance and fitness-to-dive decisions;
- insurance, licensing, and permits;
- diver certification checks and dive-safety rules and standards; and
- every operational and safety decision for your trips and your customers.
DivePrep does not verify any of these for you. A green checkmark in DivePrep means a step was marked done in the software — nothing more. The dive center remains solely responsible for its diving operations and its customers.
8. Warranty disclaimer
DivePrep is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will meet every requirement of your operation.
9. Limitation of liability
To the fullest extent permitted by law, DivePrep and its operator are not liable for any indirect, incidental, special, or consequential damages, or for any personal injury, loss of life, property damage, or losses arising out of your diving operations or your reliance on the software in place of your own professional judgment.
Our total aggregate liability for any claim relating to DivePrep is limited to the amount you paid us for the service in the twelve (12) months preceding the event giving rise to the claim.
10. Termination
You can stop using DivePrep and delete your account at any time. We may suspend or terminate accounts that breach these terms or create legal or security risk. On termination your paid entitlements end; you may export your data beforehand.
11. Changes to these terms
We may update these terms as the product evolves. For material changes we will give reasonable notice (for example, by email or an in-app notice) before they take effect. Continuing to use DivePrep after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of Switzerland, and any dispute is subject to the exclusive jurisdiction of the competent courts at the operator’s domicile in Switzerland, without regard to conflict-of-laws rules.
